Minimum wage- this is the minimum wage (SMIC), which is approved by the Government of the Russian Federation annually on the basis of the Federal Law "On the Minimum Wage". The minimum wage is calculated for a fully worked monthly norm of working time, with the employee fully fulfilling labor standards (labor duties). One of the important issues is the minimum wage. And far from an idle question is whether this indicator will be indexed next year? What will be the size of the minimum wage from January 1, 2017 in Russia? How will the minimum wage affect wages and benefits?

All these issues are very relevant, because the minimum wage affects not only wages, taxes, but also various payments, such as unemployment benefits and sick leave. In our article, we will consider the size of the minimum wage from January 1, 2017 in Russia and how this will affect payments and benefits to citizens.

Minimum wage from January 1, 2017 in the Russian Federation

The size of the minimum wage from January 1, 2017 in the Russian Federation will not be increased. Deputies of the State Duma did not increase the minimum wage from January 1 next year. At the same time, most accountants are used to the fact that the increase in the minimum wage occurs at the beginning of the year.

From January 1, 2016, the minimum wage was increased, and its value, in accordance with Article 1 of the Federal Law of December 14, 2015 No. 376-FZ, amounted to 6204 rubles. In 2017, from January 1, there will be no increase in the minimum wage.

The previous increase in the minimum wage, in accordance with Article 1 of Federal Law No. 164-FZ dated June 2, 2016, to 7,500 rubles took place in July 2016. This led to changes in the amount of benefits.

From January 1, 2017, due to the fact that the minimum wage remains at the level of 7,500 rubles, the amount of benefits will not change.

Minimum wage from January 1, 2017 and wages

In accordance with Article 133 of the Labor Code of the Russian Federation, the minimum wage is the minimum wage that an individual entrepreneur or organization must pay to employees for the full month they have worked. At the same time, the employee may receive an amount less than the minimum wage (for example, due to the deduction of alimony or personal income tax).

Thus, starting from January 1, 2017, the employer will not be able to pay the employee less than 7,500 rubles.

In accordance with the provisions of Article 129 of the Labor Code of the Russian Federation, the total salary cannot be less than the minimum wage, which includes:

  • remuneration for work;
  • compensation payments (including surcharges and allowances);
  • incentive payments (bonuses).

That is, from January 1, 2017, the total amount of the above payments cannot be less than the minimum wage - 7,500 rubles.

Minimum wage from January 1, 2017 and benefits

To calculate the amount of benefits from January 1, 2017, the minimum wage in the amount of 7,500 rubles should be taken into account. It affects the amount of benefits in two situations:

1. The length of service of an employee in an enterprise or organization is less than six months.

2. The employee's salary is below the minimum wage.

Minimum wage from January 1, 2017 and regional authorities

From January 1, 2017, local authorities in the regions have the right to set their own minimum wage in a special agreement. Article 133.1 of the Labor Code of the Russian Federation contains a rule indicating that the size of the regional minimum wage may be higher than the federal one.

The regional minimum wage can be waived. To do this, it is necessary to draw up a reasoned refusal and send it to the local branch of the Committee on Labor and Employment.

Responsibility of the employer for wages below the minimum wage

Note that if from January 1, 2017 the employee's salary is less than the minimum wage - 7500 rubles, then the employer may be held liable in the form of fines. The legislation of the Russian Federation provides for the following fines:

  • for an organization (with primary detection) - from 30,000 to 50,000 rubles;
  • for an organization (with secondary detection) - from 50,000 to 70,000 rubles;
  • for the director or chief accountant of the organization (in case of initial detection) - a warning or a fine from 1,000 to 5,000 rubles;
  • for the director or chief accountant of the organization (in case of secondary detection) - a fine from 10,000 to 20,000 rubles.

According to the norms of Article 5.27 of the Code of Administrative Offenses of the Russian Federation, the director or chief accountant of an enterprise may be disqualified for a period of one to three years.

Increase in the minimum wage from July 1, 2017

The increase in the minimum wage is planned from July 1, 2017. The minimum wage should increase by 300 rubles, and its size will be 7,800 rubles. The relevant bill provides for the indexation of the minimum wage by 4%. This is due to inflation forecasts in 2017.

Currently, in the Russian Federation, two concepts of the minimum wage (minimum wage) are legally established:

    federal minimum wage and

    regional MRO.

Articles 133 and 133.1 of the Labor Code of the Russian Federation (as amended on June 18, 2017) establish two concepts:

    the minimum wage, which is established by federal law throughout the Russian Federation (federal minimum wage), and

    minimum wage in a constituent entity of the Russian Federation (regional minimum wage).

On July 1, 2017, the federal minimum wage was raised. Now the federal minimum wage is 7,800 rubles.

The minimum wage was increased by 300 rubles (from 7,500 to 7,800 rubles) in accordance with Federal Law No. 460-FZ of December 19, 2016 "On Amendments to Article 1 of Federal Law No. 82-FZ of June 19, 2000 "On the Minimum payroll."

"Article 1. Establish the minimum wage from July 1, 2017 in the amount of 7,800 rubles per month"

The federal minimum wage is established by Article 133 of the Labor Code of the Russian Federation.

Article 133. "Establishment of the minimum wage":

    The minimum wage is established simultaneously throughout the territory of the Russian Federation by federal law and cannot be lower than the subsistence minimum for the able-bodied population.

    The minimum wage established by federal law is ensured by:

      organizations financed from the federal budget - at the expense of the federal budget, extra-budgetary funds, as well as funds received from entrepreneurial and other income-generating activities;

      organizations financed from the budgets of the constituent entities of the Russian Federation - at the expense of the budgets of the constituent entities of the Russian Federation, extra-budgetary funds, as well as funds received from entrepreneurial and other income-generating activities;

    The monthly salary of an employee who has fully worked out the standard of working hours for this period and fulfilled the labor standards (labor duties) cannot be lower than the minimum wage.

Article 133.1. "Establishing the size of the minimum wage in the constituent entity of the Russian Federation":

    In a constituent entity of the Russian Federation, a regional agreement on minimum wages may establish the amount of the minimum wage in a constituent entity of the Russian Federation.

    The amount of the minimum wage in a constituent entity of the Russian Federation may be established for employees working in the territory of the corresponding constituent entity of the Russian Federation, with the exception of employees of organizations financed from the federal budget.

    The size of the minimum wage in a constituent entity of the Russian Federation is established taking into account the socio-economic conditions and the subsistence level of the able-bodied population in the corresponding constituent entity of the Russian Federation.

    The minimum wage in a constituent entity of the Russian Federation cannot be lower than the minimum wage established by federal law.

    The amount of the minimum wage in a constituent entity of the Russian Federation is ensured by:

      organizations financed from the budgets of the constituent entities of the Russian Federation - at the expense of the budgets of the constituent entities of the Russian Federation, extra-budgetary funds, as well as funds received from entrepreneurial and other income-generating activities;

      organizations financed from local budgets - at the expense of local budgets, extra-budgetary funds, as well as funds received from entrepreneurial and other income-generating activities;

      other employers - at their own expense.

    The development of a draft regional agreement on minimum wages and the conclusion of this agreement are carried out by the tripartite commission for the regulation of social and labor relations of the relevant subject of the Russian Federation in the manner prescribed by Article 47 "The procedure for developing a draft agreement and concluding an agreement" of the Labor Code.

    After the conclusion of a regional agreement on the minimum wage, the head of the authorized executive body of a constituent entity of the Russian Federation invites employers operating in the territory of this constituent entity of the Russian Federation and who did not participate in the conclusion of this agreement to join it. This proposal is subject to official publication along with the text of this agreement. The head of the authorized executive body of the constituent entity of the Russian Federation notifies the federal executive body responsible for the development of state policy and legal regulation in the field of labor of the publication of the said proposal and agreement.

    If within 30 calendar days from the date of the official publication of the proposal to join the regional minimum wage agreement, employers operating in the territory of the relevant subject of the Russian Federation have not submitted a reasoned written refusal to join it to the authorized executive body of the subject of the Russian Federation, then the said agreement is considered extended to these employers from the date of the official publication of this proposal and is subject to mandatory execution by them. This refusal must be accompanied by a protocol of consultations between the employer and the elected body of the primary trade union organization uniting employees of this employer, and proposals on the timing of raising the minimum wage of employees to the amount provided for by the specified agreement.

    If the employer refuses to join the regional agreement on minimum wages, the head of the authorized executive body of the constituent entity of the Russian Federation has the right to invite representatives of this employer and representatives of the elected body of the primary trade union organization uniting employees of this employer for consultations with the participation of representatives of the parties to the tripartite commission for regulating social - labor relations of the corresponding subject of the Russian Federation. Representatives of the employer, representatives of the elected body of the primary trade union organization and representatives of the specified tripartite commission are obliged to take part in these consultations.

    Copies of employers' written refusals to join the regional agreement on minimum wages are sent by the authorized executive body of the constituent entity of the Russian Federation to the appropriate territorial body of the federal executive body authorized to exercise federal state supervision over compliance with labor legislation and other regulatory legal acts containing labor law norms.

    The monthly salary of an employee working in the territory of the relevant subject of the Russian Federation and who is in an employment relationship with an employer in respect of which a regional agreement on the minimum wage is in force in accordance with parts three and four of Article 48 of the Labor Code of the Russian Federation or for which the said agreement is extended in the manner established by parts six - eight of this article, cannot be lower than the minimum wage in this constituent entity of the Russian Federation, provided that the specified employee has fully worked out the norm of working hours for this period and fulfilled labor standards (labor duties).

Based on the above federal legislative norms (Articles 133 and 133.1 of the Labor Code of the Russian Federation), most of the subjects of the Russian Federation in their territories introduce their own regional minimum wage, which exceeds the minimum wage established at the federal level (federal minimum wage).

The minimum wage in Moscow and the Moscow region depends on:

    from the subsistence minimum in the region,

    as well as from the federal minimum wage.

Since the subsistence minimum in these regions is reviewed quarterly, and since July 1, the federal minimum wage has been increased, the minimum wage in Moscow and the Moscow Region has also changed since July 1, 2017.

The minimum wage (minimum wage) from July 1, 2017 in Moscow

In Moscow, the value of the minimum wage depends on the subsistence level of the able-bodied population.

Moscow trilateral agreement for 2016-2018 dated 12/15/2015.

The subsistence minimum is approved once every three months. With an increase in the subsistence minimum, an increase in the regional minimum wage follows. The new minimum wage in Moscow begins to operate from the 1st day of the month following the month when the next resolution on the subsistence minimum comes into force. But if the cost of living has not changed or even decreased, then the minimum wage in Moscow remains the same.

In the 4th quarter of last year, the living wage in Moscow was reduced to 17,487 rubles from 17,561 rubles in the 3rd quarter (?). Therefore, the minimum wage in Moscow has not changed and has amounted to 17,561 rubles since January 1, 2017.

As of July 1, 2017, it has grown to 17 624 rubles per month (with bonuses and allowances). Such a living wage for the able-bodied population was established by the Moscow Government.

Decree of the Government of Moscow of June 13, 2017 N 355-PP "On the establishment of the subsistence minimum in the city of Moscow for the 1st quarter of 2017"

The new minimum wage in Moscow in the amount of 17,624 rubles is effective from July 1, 2017.

Salaries of employees with bonuses and allowances must not be lower than this level of the minimum wage. Therefore, capital companies need to raise the salaries of employees to 17,624 rubles per month, if they are lower.

You can opt out of the regional minimum wage and stick to the federal minimum wage. Reasoned refusals must be sent within 30 calendar days from the date of the official publication of the Moscow government decree on the new subsistence minimum. The refusal must be sent to the Moscow Tripartite Commission.

If the company has not officially abandoned the regional minimum wage and does not comply with it, then the employer may be held liable in the form of fines:

    penalty for the organization:

      can range from 30,000 to 50,000 rubles,

      and in case of repeated detection of this violation - from 50,000 to 70,000 rubles;

    fine for the director or chief accountant:

      in case of a primary violation - they can issue a warning or issue a fine from 1,000 to 5,000 rubles,

      if repeated - a fine of 10,000 to 20,000 rubles. Moreover, they can be disqualified for a period of one to three years.

The minimum wage (minimum wage) from July 1, 2017 in the Moscow region

Since January 1, 2017, the minimum wage in the amount of 13,750 rubles has been in force in the Moscow Region.

In 2016, the minimum wage was changed only once, so it is possible that from July 1, 2017, the minimum wage for the Moscow Region will be revised. So far, the current minimum wage in the Moscow Region - 13,750 rubles - is used by all employers in the Moscow Region who did not switch to the federal minimum wage in January 2017.

For all employers who have timely abandoned the regional values ​​of the minimum wage and switched to the federal minimum wage, in Moscow and the Moscow Region, from July 1, 2017, the minimum wage will be 7,800 rubles.

The salary of employees cannot be lower. Otherwise, the employer will be held liable for violating the labor rights of employees.

How salaries have changed in Moscow and the Moscow region

Moscow employers have reason to raise salaries. Moscow over the past year showed an increase in all industries:

    the maximum increase in financial companies - plus 18.5 thousand rubles,

    least of all, average salaries increased in the "Hotels and restaurants" industry - plus 906 rubles.

The essence of the concept of the minimum wage

The minimum wage in Russia is a measure used to:

  • wage regulation;
  • calculation of benefits for temporary disability, pregnancy and childbirth;
  • other purposes of compulsory social insurance.

In abbreviated form, the lower salary threshold is abbreviated as "minimum wage". It is installed on two levels:

  • as a whole for the federation;
  • separately in each region (indicators may differ in value).

Starting from 01/01/2019 onwards, the federal minimum wage is annually set in the amount of the subsistence minimum for the able-bodied population in the whole country for the second quarter of the previous year. At the same time, if the indicator has decreased compared to the previous year, then the minimum wage remains the same for this year.

In a market economy, the employer himself appoints a salary to employees based on the current situation, costs and other factors. Unfortunately, not all owners of firms and industries care about the interests of the population. This function in the Russian Federation is entrusted to the state as part of the formation of economic policy. Factors affecting the size of the minimum wage


The calculation of the weighted value of the minimum wage is a labor-intensive process carried out continuously by specialists.
The following factors are taken into account in the calculation:

  1. government policy in the field of pricing;
  2. inflation indicators (and their estimates);
  3. the needs of the population, that is, the so-called subsistence minimum (PM);
  4. the number of official unemployed and others.
Attention: the starting conditions determined by the listed factors are very different in parts of the federation. Therefore, each region has the opportunity to establish its fair and justified, from the point of view of the economic condition, minimum wages.

The minimum wage set in the region cannot be lower than the minimum wage set at the federal level. If the minimum wage is not established in the region, the federal minimum wage applies.

The size of the minimum wage by regions

At the federal level, the minimum wage is currently set at 11,280 rubles. Most regions have equated the value of their minimum wages with the federal one, since the regional authorities do not have the right to set the level of wages below this minimum. But there are subjects of the country that have gone further, namely, they have raised the minimum wage for certain categories of workers above the federal level.

  • Volgograd region - 13,190 for non-budgetary organizations;
  • Kaliningrad region - 12,500 rubles;

Some features of the application of the minimum wage in calculations

The accountant needs to take into account the size of the minimum wage set by the governments of both levels of government. It should also be borne in mind that the minimum wage does not include regional and percentage bonuses accrued for work in special climatic conditions, including in the regions of the Far North and equivalent areas.

The rules are:

  1. The amount of accruals per month cannot be lower than the federal indicator (with the exception of the preferential regime of work).
  2. The regional value is used by enterprises that have joined the minimum wage agreement.
  3. If the organization has not become a party to a tripartite agreement, then the all-Russian minimum wage is used.

Salary less than the minimum wage: in what cases is it possible


  1. An employee works part-time or part-time. The salary will be calculated in proportion to the hours worked or depending on the amount of work performed. It is necessary to conclude an additional agreement.
  2. Deduction of income tax from salary. The employee's salary is set at the minimum wage, but the employer, as a tax agent, must accrue tax deductions for the established amount.
  3. Deductions from wages under a writ of execution, for example, on account of the payment of alimony.
  4. An employee combines work for several employers. In this case, it is possible to hire on a part-time basis (no more), therefore, the salary will be less or 50% of the minimum wage.
  5. The salary of an employee includes a fixed salary and bonuses (allowances). If the monthly norm is not met, then the allowance (premium) is not charged. As a result, the amount of salary payable may be less than the minimum wage.
  6. Being on sick leave.
  7. Being on leave without pay.
  8. Worker walk.
  9. Work under a civil law contract. In the event that the employee is employed not under an employment contract, but under a contract for the provision of services or work. In this case, labor relations are not subject to the requirements of labor legislation and wages may be lower than the minimum wage.

Salary less than the minimum wage: responsibility in 2020

If the above conditions are not met at the enterprise and employees are paid salaries less than the minimum threshold, penalties will follow (clause 6 of article 5.27 of the Code of Administrative Offenses of the Russian Federation).

The amount of fines depends on:

  • the number of violations;
  • the size and legal status of the enterprise.
  1. For the primary violation - a fine of 1-5 thousand rubles.
  2. In case of repeated violation - a fine of 10-20 thousand rubles.

For officials:

  1. For the primary violation - a fine of 10-20 thousand rubles.
  2. In case of repeated violation - a fine of 20-30 thousand rubles.

For legal entities:

  1. For the primary violation - a fine of 30-50 thousand rubles.
  2. In case of repeated violation - a fine of 50-70 thousand rubles.

Disqualification for officials for a period of 1-3 years may also be applied.

Important! The minimum wage in the Russian Federation includes salary, bonuses (allowances, raises). Therefore, the salary itself may be lower than the minimum minimum wage (allowed by law), if the employee’s total monthly income, taking into account all additional payments, is equal to the minimum wage (letter of the Ministry of Health and Social Development of Russia dated July 9, 2010 No. No. 14-1/OOG-7353). Attention! At the end of 2017, the Constitutional Court of the Russian Federation clarified that there are exceptions to this rule: northern regional coefficients and allowances cannot be included in the minimum wage (Resolution of the Constitutional Court of December 7, 2017 No. 38-P). Since this violates the principle of social justice for citizens living in areas with severe natural and climatic conditions.

Other financial obligations of employers

In addition to maintaining salary compliance at a level not lower than the minimum wage, employers are also responsible for indexing wages. It is provided for in Art. 134 of the Labor Code of the Russian Federation and is based on the dynamics of consumer prices in the region of the company's operations. If the employer does not index wages in a timely manner, administrative sanctions may be applied to him.

Thus, in 2018, the Federal Tax Service of the Tambov Region informed all commercial organizations in the region about the need to conduct mandatory indexation of employees' salaries (and retroactively) in 2018.
